The general terms of conditions and the data protection declaration apply to the competition for the domains epaper.bauhandwerk.de, epaper.this-magazin.de, epaper.shk-profi.de, epaper.bft-international.com, epaper.bauwelt.de, epaper.dbz.de, epaper.metallbau-magazin.de, epaper.dach-holzbau.de, epaper.bundesbaublatt.de, epaper.tab.de, epaper.zi-online.info, epaper.tunnel-online.info, epaper.facility-management.de, epaper.kka-online.info, epaper.zkg.de, epaper.recovery-worldwide.com and epaper.at-minerals.com (hereinafter named as organizer domains), which Bauverlag BV GmbH (hereinafter named as organizer), Friedrich-Ebert-Str. 62 organized. Terms of condition of the organizer domains

The competition is operated for the on the organizer domain of the company named in the imprint. The nature and scope of the prizes, the dates of participation and the way in which the prizes are awarded can be found in the competition announcement by the competition organizer. The organizer uses the service provider HAPPY Marketing Solutions AG for the processing of the competition.

1 Scope

1.1 The terms of conditions apply to the competition, which is advertised on the organizer's domain.

1.2 The following terms of condition contain the conditions that apply exclusively between the participant in the competition and the organizer, insofar as these have not been agreed in writing in accordance with Section 14.1. of these Terms may be modified between the parties.

1.3 Participation in the competition is only possible if these terms of conditions will be accepted. The participant will be informed of the terms of conditions legally correct and before the participation.

1.4 If you participate in the competition, the current and displayed terms of conditions apply.

1.5 The terms of conditions also apply if the domain is accessed from outside of Germany.

1.6. The participant formally agrees that the applicable law of the host country will apply.

2 Eligible participants

2.1 Anyone who has participated on the landing page is eligible to participate.

2.2 Effective participation in the competition is only possible if the participant has the minimum age of 18 at the time of participation. Another requirement is still the ownership of your own e-mail address and the use of the same.

2.3 Employees, authorized representatives and representatives of the organizer and their respective family and household members as well as all persons who are disqualified according to number 8 of the terms of conditions or who are excluded from the competition or blocked are not eligible to participate. If these requirements are not met, all claims against the organizer are void.

2.4 Participation is only possible if the correct user data are provided. The participant is liable for the incorrect personal data and must indemnify the organizer from third-party claims in this regard.

2.5 Please note that the data specified under point 3 must be provided when participating. The data required to carry out and process the competition will be collected and stored by us in accordance with the statutory provisions. Please refer to the attached data protection for details.

3 participation

3.1 Participation in the competition is free.

3.2 At least the e-mail address is required to participate in the competition. You can also provide voluntary information.

3.3 Each participant can only enter the competition once. Playing on behalf of third parties or participation via "straw men" is not permitted. The winner is solely responsible for paying any applicable taxes.

3.4 Participation via the Internet takes place through the online registration.

3.5 Each participant can only be registered and drawn once.

3.6 Participation in the respective draws with entitlement to wins is only possible if registration took place on the organizer domain by midnight on the day before the draw. The system time of the server applies. The closing date for entries for the last draw is December 31, 2022.

3.7 Each duly and timely registered entrant will take part in the draws as announced at the competition.

3.8 Timely receipt by the organizer domain is decisive for participation in a prize. Entries not received by the deadline set out in 3.6 will be treated as such for the drawing from the next drawing day.

3.9 Activation is only required once and automatically ensures participation in subsequent draws.

3.10 If one or more draws have already taken place when you participate for the first time, there is no retrospective entitlement to a prize.

3.11 The first and last draw day and the number of draws offered will be announced in the respective competition. Entries received after the last announced drawing date cannot be considered.

4 Sweepstakes and Prizes

4.1 The start date of the competition is 05/20/2022

4.2 The closing date for entries is December 31, 2022.

4.3 Drawing days for the prizes are 30/06/2022, 31/07/2022, 31/08/2022, 30/09/2022, 31/10/2022, 30/11/2022 and 31/12/2022.

4.4 In each draw there are several prizes according to the award. See the following list:

4.5 The winners of the monthly draws from June to November will be determined by a draw from all participants duly activated on the day of the draw.

4.6 The chance of winning the Audi e-tron GT brand car will be determined on December 31, 2022. To this end, each participant who has registered properly by this point in time will be assigned their own prize code. A prize is won if the winning code of a participant matches a winning code from the code pool randomly determined by the organizers agency for this competition.

4.7. In the event of a win, the Audi e-tron GT will be configured and ordered by Bauverlag BV GmbH. Delivery and handover to the winner will take place after delivery by the manufacturer to the organizer. Delivery depends on the delivery times offered by the manufacturer at the time of winning; it may be delayed several times due to delivery difficulties.

4.8 If a prize notification fails, the claim to the prize expires after 4 weeks. In this case, a substitute winner will be drawn from the participants available on the day of the draw.

4.9. A phone number will be requested from the winner to process the prize.

5 Notification of Entrants, Winners and Payment of Prizes

5.1 The winners will be notified by the organizer or its service provider. The notification is made exclusively via the e-mail address provided by the participant. It is solely the responsibility of the participant to be able to reach the participant via the e-mail address provided. If the participant cannot be reached via the email address provided, the organizer is not obliged to contact or locate the participant in any other way.

5.2 All winners must contact the organizer with their personal data within one month of being notified of the draw. You must then identify yourself as the winner (by presenting a valid passport or identity card) and sign a confirmation of your win. If this does not happen, the prize is forfeited.

5.3 If the data transferred is identical to the data stored on the organizer's domain, the prizes will be handed over as agreed.

5.4 In the event of a dispute, especially if there are discrepancies about the name, the data stored on the organizer's domain are decisive for the data comparison.

5.6 The prizes advertised are based on the competition. The rules specified in the advertisement apply.

5.7 With his/her participation, the participant gives the organizer or its service provider express permission to publish the first name, first letter of the last name, place of origin and a photo on one of the internet pages of the organizer and its service provider in the event of a win.

6 Loss of entitlement to prizes

If a prize notification fails because the prize notification was not delivered to the address details provided, the prize claim expires. A prize notification is also considered unsuccessful if a request by e-mail, post or telephone to leave a current address for delivery of the prize notification within four weeks remains without a response.

7 Limits and Taxes

The right to win is not transferable to third parties. The right to receive the prize in cash is excluded unless cash prizes are awarded. The winner has to pay for any taxes that may be incurred, insofar as it is a tax claim from the tax authorities.

8 Rules of Conduct, Disqualification and Suspension

8.1 The organizer or its service provider has the right to disqualify and exclude participants from the competition who influence the participation process in a way that violates good faith, e.g. by manipulating the software or violating the rules of the game, or their behavior in any other way exceeds the limits of what is reasonable, e.g. through threats or unreasonable harassment (insult, slander, extreme number of calls in the form of "telephone terror" etc.) of employees of the organizer or its service providers.

8.2 Furthermore, the organizer or its service provider can also exclude participants from participation at their discretion in advance if a violation of the provisions in Section 8.1. listed rules of conduct threatens.

9 termination/change options

9.1 The organizer reserves the right to interrupt or terminate the competition at any time without prior notice, provided there is a legitimate interest in doing so. This can be the case in particular in the case of technical problems or legal concerns.

9.2 The organizer reserves the right to cancel the competition in whole or in part (e.g. for certain prizes or special draws) after a daily drawing and allocation of the prizes. This applies in particular if the raffle cannot run as planned for any reason, such as computer viruses, software and/or hardware errors and/or other technical and/or legal reasons affecting administration, security, integrity and/or affect the regular and proper conduct of the prize draw.

9.3 The organizer reserves the right to restrict the availability of the organizer's domain, in particular for technical reasons (e.g. maintenance and servicing) or to suspend it for a temporary period. Due to an overload of the access accounts or in the event of system disruptions, there may also be short-term failures of the website, individual services or the access accounts. This does not result in any claims against the organizer. In particular, no liability is assumed if e-mails or data entries (in masks on the website) do not meet the requirements set out there and are consequently not accepted and/or accepted by the system. Furthermore, the organizer is not liable in the event of theft or destruction of the systems and/or storage media storing the data or in the event of unauthorized change and/or manipulation of the data in the systems and/or on the storage media by the participants or third parties.

With the participation in the competition, legal recourse is excluded. There is no enforceable claim to the payment of the winnings.

11 Data Protection

User data is processed with the utmost care and in compliance with statutory provisions. The processing of the data entered in the entry form takes place exclusively for the implementation of the competition contract (Art. 6 I b) GDPR), which you conclude by your voluntary participation in this competition. 12 Liability

12.1 In the event of a link to the websites of partners, sponsors and advertising partners, the organizer has no influence on the linked sites. He does not adopt their content as his own.

12.2 Liability for data loss is limited to the typical recovery effort that would have occurred if backup copies were made regularly and appropriate to the risk.

13 Severability Clause

Should individual parts of this contract be ineffective or unenforceable or become ineffective or unenforceable after the conclusion of the contract, the validity of the rest of the contract remains unaffected. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision whose effects come closest to the economic objective pursued by the contracting parties with the invalid or unenforceable provision. The above provisions apply accordingly in the event that the contract proves to be incomplete.

14 Final Provisions

14.1 Changes or additions to these Conditions of Participation must be in a written form. This also applies to the lifting of the writing requirement. The competition is exclusively subject to the law of Germany.

14.2 If the participant is a merchant within the meaning of the German Commercial Code, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes that arise in the course of the processing of this contractual relationship is the place of jurisdiction of the organizer's registered office agreed.
